Write my Sally A Allens Trial Case Paper

This paper is devoted to one juridical case that aroused my interest. Sally A. Allen initiated a claim after having been bitten by her neighbor's cat. At approximately 7.30 a.m. on March 25, 2005 the plaintiff had been attacked by the defendants' cat. The Cox's cat bit Sally Allen's arm after she had broken up a fight between the latter and her own cat.

In addition it has been evidenced and testified that the Cox cat was not neutered, often picked fights with other cats, was covered in scars and bruises and spent most of the time on the street. As Linda DelFino, one of the neighbors, had stated in her affidavit, the cat was known to pose problems when kept indoors and it owners let it outside, while the neighbors generally chose to keep their cats at home and out of the Cox's cat way.

The trial court presented the summarized judgment for the defendant on the basis of the fact that there was no unique matter of material fact as to whether the defendants saw their cat being vicious. The plaintiff delivered an appeal from the trial court's judgments, as a result of which the judgment of the trial court was reversed.

So, the main issue of the case is whether a cat owner bears the duty of care to prevent the cat from injuring people and whether the owner may be held liable for the cat's behavior.
